Welcome to OneMagnify!

OneMagnify ("we," "us," "our") is dedicated to protecting your privacy. We provide integrated marketing, data analytics, and technology solutions. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website at www.onemagnify.com (“Site”), interact directly with us (for example, when you inquire about our services, subscribe to our newsletters, apply for a job, register for an event/webinar), and when we process personal data as part of the services we provide to our business clients (collectively, with the Site, the “Services”).

When we collect, use, disclose, and safeguard your information, we are subject to the General Data Protection Regulation which applies across the European Union (“GDPR”), the United Kingdom General Data Protection Regulation (“UK GDPR”), and various laws in the United States, and we are responsible as “Data Controller” of that personal data for the purposes of those laws (further discussed below).

By creating an account, providing information to us (by any means, whether in correspondence, via our Site, or otherwise), or continuing to use our Services, you acknowledge that you have read, understood, and consent to be bound by this Privacy Policy.

We may collect and use information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual (or a household) (“personal data”).   Please read this policy carefully to understand our practices regarding your personal data.

 

2. Our Roles: Data Controller vs. Data Processor

 

Understanding how we handle data starts with clarifying our roles:

  • When We Are the Data Controller: We act as a “Data Controller” when we collect personal data directly from you for our own purposes. This primarily includes data collected through our Site (www.onemagnify.com) when you inquire about our services, subscribe to our newsletters, apply for a job, or otherwise interact directly with us for our business operations. In this role, we determine the purposes and means of processing your personal data.
  • When We Are a Data Processor: We primarily act as a “Data Processor” when we provide our integrated marketing, data analytics, and technology solutions to our business clients. In this scenario, our client is the Data Controller, and they determine the purposes and means for processing the personal data they provide to us or authorize us to collect on their behalf (e.g., their customer data, user data).

This Privacy Policy explains our practices solely when we are the Data Controller. Our commitments when we act as a Data Processor are subject to a services agreement between us and our business clients. In the event we are acting as a Data Processor, we process this data strictly based on the business client's instructions and the terms of our service agreements and Data Processing Agreements (DPAs) with them.

 

3. Personal Information We Collect (When We Are the Controller)

 

When you interact directly with us, primarily through our Site, we collect personal data you provide to us and information about your interactions with our Site. The types of personal data we collect include:

  • Personal Identifiers & Contact Information: This includes details such as your name, email address, phone number, job title, company name, and other contact details you provide when you fill out forms, register for events, subscribe to content, or contact us.
  • Professional Information: Information related to your business or professional role, such as your company's industry, size, and your specific interest in our services.
  • Communications & Marketing Data: Your preferences in receiving marketing from us and your communication preferences, as well as records of our communications with you.
  • Usage Data: Information about how you interact with our Site and services. This includes data such as the pages you visit, the time spent on those pages, the links you click, search queries, and other actions you take while using our Site.
  • Technical Data: Information about your device and internet connection, such as your IP address, browser type and version, time zone setting, geographical location (city/country derived from IP), operating system and platform, and other technical identifiers.

Sources of Data: We collect this primarily information directly from you. We may also collect some technical and usage data automatically through cookies and similar technologies (see Section 5).

Sensitive Personal Information: We generally do not collect sensitive personal data (such as race, ethnicity, health data, political opinions, precise geolocation) through our Site or for our own direct marketing purposes. If we ever need to collect sensitive data for a specific, legitimate purpose (e.g., for employee recruitment, which would be covered by a separate policy), we will do so only with your explicit consent or as required by law, and we will provide specific notice about the type of sensitive data collected and its use.

 

4. How We Use Your Information (When We Are the Controller)

 

We use the personal data we collect when acting as a Data Controller for the following business purposes. Under GDPR, we must have a lawful basis for processing your data; these bases are noted below:

  • To Provide Service Information & Portfolio Showcase: To inform you about our services, show case studies, project examples, and testimonials.
    • Lawful Basis: Legitimate Interests (marketing our services) or Consent (if required for specific types of direct marketing).
  • To Scope Projects & Provide Pricing: To understand your project requirements, create proposals, and offer accurate pricing.
    • Lawful Basis: Performance of a Contract (or to take steps at your request before entering a contract) or Legitimate Interests (managing business inquiries).
  • To Explore Partnership Opportunities: To discuss potential collaborations if you express interest.
    • Lawful Basis: Performance of a Contract (or to take steps at your request before entering a contract) or Legitimate Interests (business development).
  • To Address Other Inquiries & Provide Support: To respond to your questions and requests and provide customer support.
    • Lawful Basis: Performance of a Contract (if related to existing services) or Legitimate Interests (managing customer service and inquiries).
  • To Operate, Maintain & Improve Our Site: To ensure our Site functions correctly, analyze usage trends, and improve user experience.
    • Lawful Basis: Legitimate Interests (operating and improving our business and Site).
  • For Marketing Communications: To send you updates, newsletters, and promotional materials about our services that may be of interest to you.
    • Lawful Basis: Consent (for email marketing where required by law) or Legitimate Interests (direct marketing to business contacts where permitted). You can opt-out at any time (see Section 8).
  • For Security & Fraud Prevention: To protect our Site, systems, and data from security threats and fraudulent activity.
    • Lawful Basis: Legitimate Interests (protecting our business and users) or Legal Obligation.
  • To Comply with Legal Obligations: To meet legal, regulatory, or compliance requirements.
    • Lawful Basis: Legal Obligation.

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason that is compatible with the original purpose and applicable law.

We may also anonymize, aggregate or de-identify personal data so the end-product does not identify you or any other individual and if anonymized or deidentified, we commit to use the information in deidentified form and not to attempt to reidentify the information, except where permitted by law. Such aggregated, anonymized or de-identified information is not considered personal data for purposes of this Privacy Policy and we may use it for any purpose. We may use this information, for example, to generate norms by industry, geography, level, etc., enable us to understand where our services are being utilized, conduct ongoing validation studies, compile reports, and improve the services.

 

5. Data Retention

 

We retain your personal data only for as long as necessary to fulfill the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process your personal data, and whether we can achieve those purposes through other means, and the applicable legal requirements.

We use cookies and similar technologies on our Site to collect Usage Data and Technical Data (as described in Section 3), distinguish you from other users, remember your preferences, and improve your browsing experience.

7. Sharing and Disclosure of Your Personal Information (When We Are the Controller)

 

We may share your personal data collected as a Controller with the following categories of third parties for the purposes described in Section 4:

  • Service Providers: We may utilize and share data with third-party vendors, consultants, and other service providers who perform services for us or on our behalf to provide business, professional, or technical support services to us and/or administer activities on our behalf (e.g., website hosting, email delivery, CRM services). These service providers are contractually bound to protect your information and use it only for the purposes for which we disclose it to them.
  • Analytics Providers: We may share your personal data to parties that assist us in performing analytics and help us measure the effectiveness of the Site and our marketing and advertising efforts.
  • Marketing and Advertising Partners: We may share your personal data to our marketing and advertising partners, including social media networks, third-party advertising networks, and other parties that assist us in serving, measuring the performance of, and optimizing our advertisements.
  • Business Partners: With whom we may partner to offer joint services or promotions.
  • Legal and Regulatory Authorities: We disclose your personal data to government and public authorities if required to do so by law, court order, or legal process, or in response to a lawful request from government authorities, including to meet national security or law enforcement requirements.
  • Business Transfers: To may share your personal data with an acquirer, successor, or assignee in connection with or during negotiations of any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.
  • With Your Consent: We may disclose your personal data for any other purpose with your consent.

We may also need to share some personal data with other parties to the extent we believe it is necessary or appropriate to (1) protect our operations and those of our affiliates and subsidiaries; (2) investigate and prevent against fraud and other illegal activity; (3) protect our rights, privacy, safety, property, and/or those of others; or (4) allow us to pursue available remedies or limit damages that we may sustain.

We may disclose your personal data for other reasons described at the time of information collection or prior to disclosing your information. Additionally, we may disclose your personal data with your consent or when you direct us to do so.

Except as set forth above, we will not share your personal data with any other third party.

 

8. International Data Transfers

 

We are headquartered in the United States of America and utilize service providers both in the United States and throughout the world. As such, we and our service providers may transfer your personal data to, or store or access it in, jurisdictions that may not provide equivalent levels of data protection as your home jurisdiction. In particular, you are advised that the United States of America uses a sectoral model of privacy protection that relies on a mix of legislation, governmental regulation, and self-regulation. We will, however, ensure the transfer complies with data protection law and all personal data will be secure.

If you are located outside the United States, we will only transfer your personal data if:

  • you provide your explicit consent;
  • the country to which the personal data will be transferred has been granted an appropriate adequacy decision by your local supervisory authority; or
  • we have put in place appropriate safeguards in respect of the transfer, for example we have entered into the appropriate standard contractual clauses and required additional safeguards with the recipient, or the recipient is a party to binding corporate rules approved by a supervisory authority.

By using our Site or providing us with information, you understand that your information may be transferred to countries outside of your country of residence, which may have data protection rules that are different from those of your country. Where the laws of your country allow you to do so, by using the our Services, you consent and authorize us to transfer, store, and use all such information in the United States and any other country where we operate which may not offer an equivalent level of protection to that required in the country where you reside and to the processing of that information by us on its servers located in the United States as described in this Privacy Policy. If you do not want your personal data transferred to the United States and any other country where we operate, please do not submit any information to us or use our services

We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy and applicable laws.

 

9. Use of Artificial Intelligence (AI)

 

As part of our advanced technology solutions, we may utilize Artificial Intelligence (AI), Machine Learning (ML), and other sophisticated algorithms to process data on behalf of and under the instructions of our clients. This AI processing is used for purposes defined by our clients, such as analyzing trends, segmenting audiences, personalizing content, optimizing campaigns, or generating insights.

 

10. Data Security

 

We are committed to protecting the personal data we collect and process. We implement appropriate technical and organizational measures designed to safeguard your personal data from unauthorized access, use, alteration, and disclosure. These measures include, where appropriate, encryption, access controls, secure storage solutions, and regular security assessments.

While we strive to protect your personal data, no security system is impenetrable. We cannot guarantee the absolute security of your data transmitted to our site. Any transmission is at your own risk.

Data Breach Notification: We have procedures in place to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so, in accordance with applicable laws.

 

11. Third Party Websites

 

If, in your interactions with the Site, you are linked or directed to, or click on, a third party website, we cannot control what information you may provide to that party or on that website, and we are not responsible for how that party may use or disclose any information you may provide to them. This is not as an endorsement by us of any third party website, content that may be offered on such third party website, or of any products or services provided by such third party. We do not control, nor are we responsible for, such third party website, product or service offerings. As such, we urge that you exercise caution before providing them with your personal data and to review the third party’s privacy policy for information on its data processing practice.

You should contact the site administrator for such third party website if you have any complaints, claims, concerns or questions regarding such third party website or its privacy practices.

 

12. Children’s Privacy

 

Our Site and Services are not intended for individuals under the age of 18. We do not knowingly collect personal data from children under 18 through our Site. If you are under 18, do not use our services, access the Site, or provide any information about yourself including, without limitation, your name, address, email address or any screen name or user name you may use. If we become aware that we have collected personal data from a child under 18 without parental consent, we will take steps to delete such information. If you believe we may have any information from or about a child under 18, please see our “Contact Us” Section below.

For data processed on behalf of clients, our clients are responsible for ensuring they have the necessary consents or legal basis to process data relating to children, including any data processed by us using AI.

 

13. Your Data Protection Rights 

 

Under CCPA/CPRA

You may have the right under the California Consumer Privacy Act of 2018 (CCPA), the California Privacy Rights Act of 2020 (CPRA), and certain other privacy and data protection laws, as applicable, to exercise free of charge:

Disclosure of Personal Information We Collect About You

You have the right to know:

  • The categories of personal data we have collected about you;
  • The categories of sources from which the personal data is collected;
  • Our business or commercial purpose for collecting or selling personal data;
  • The categories of third parties with whom we share personal data, if any; and
  • The specific pieces of personal data we have collected about you.
  • Please note that we are not required to:
  • Retain any personal data about you that was collected for a single one-time transaction if, in the ordinary course of business, that information about you is not retained;
  • Reidentify or otherwise link any data that, in the ordinary course of business, is not maintained in a manner that would be considered personal data; or
  • Provide the personal data to you more than twice in a 12-month period. 

Personal Information Sold or Shared for a Business Purpose

In connection with any personal data we may sell or disclose to a third party for a business purpose, you have the right to know:

  • The categories of personal data about you that we sold and the categories of third parties to whom the personal data was sold; and

  • The categories of personal data that we disclosed about you for a business purpose.

Right to Limit Use and Disclosure of Sensitive Personal Information.

You have the right to opt-out of the use and disclosure of your sensitive personal data for anything other than supplying requested goods or services.

We do not collect sensitive personal data. 

Right to Correction You have the right to request correction of inaccurate personal data maintained by us about you. Upon receipt of a verifiable request from you, we will use commercially reasonable efforts to correct the inaccurate personal data.
Right to Deletion

Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:

  • Delete your personal data from our records; and
  • Direct any service providers to delete your personal data from their records.

Please note that we may not delete your personal data if it is necessary to:

  • Complete the transaction for which the personal data was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;
  • Debug to identify and repair errors that impair existing intended functionality;
  • Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;
  • Comply with the California Electronic Communications Privacy Act;
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent;
  • Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;
  • Comply with an existing legal obligation; or
  • Otherwise use your personal data, internally, in a lawful manner that is compatible with the context in which you provided the information. 
Protection Against Discrimination  

You have the right to not be discriminated against by us because you exercised any of your rights under the CCPA. This means we cannot, among other things:

  • Deny goods or services to you;
  • Charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;
  • Provide a different level or quality of goods or services to you; or
  • Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

Please note that we may charge a different price or rate or provide a different level or quality of services to you, if that difference is reasonably related to the value provided to our business by your personal data. 

 

Under Other State Privacy Laws

Depending on your location and the specific privacy laws that apply to you, you may have the certain rights regarding your personal data that we process as a Data Controller.  This section describes the rights you may have under these state privacy laws, under certain circumstances and subject to certain exceptions. Please contacts us if you have any questions about your rights under these state privacy laws.

  • Right to Be Informed: You may have the right to confirm whether we are processing personal data concerning you and to be informed about the collection and use of your personal data (provided by this policy).
  • Right to Access: To request a copy of the personal data we hold about you.
  • Right to Rectification: To request that we correct any inaccurate or incomplete personal data we hold about you.
  • Right to Erasure (or "Right to Be Forgotten"): To request that we delete your personal data in certain circumstances.
  • Right to Restrict Processing: To request that we restrict the processing of your personal data in certain circumstances.
  • Right to Object to Processing: To object to the processing of your personal data in certain circumstances, including against processing based on legitimate interests or for direct marketing purposes, targeted advertising, the sale of personal data, or the profiling in furtherance of decisions that produce legal or similarly significant effects concerning the consumer.
  • Right to Data Portability: To request to receive your personal data in a structured, commonly used, and machine-readable format and to transmit that data to another controller.
  • Right to Appeal: We hope that we can resolve any query or concern you raise about our use of your personal data. However, if we do not take action on your request to exercise any of your rights, we will inform you without undue delay after the receipt of the request our reason for not taking action. You may appeal any decision we have made about your request by following the instructions in the communication you receive from us notifying you of our decision.

Under GDPR and UK GDPR

In the European Economic Area and the UK, you have certain rights under applicable data protection laws:

  • Right to Access: The right to be provided with a copy of your personal data.
  • Right to Rectification: The right to require us to correct any mistakes in your personal data.
  • Right to be Forgotten: The right to require us to delete your personal data —in certain situations. At your request, we will delete your personal data promptly if:
    • it is no longer necessary to retain your personal data;
    • you withdraw the consent which formed the basis of your personal data processing;
    • you object to the processing of your personal data and there are no over-riding legitimate grounds for such processing;
    • the personal data was processed illegally; or
    • the personal data must be deleted for us to comply with our legal obligations.

We will decline your request for deletion if processing of your personal data is necessary:

  • to comply with our legal obligations;
  • in pursuit of a legal action;
  • to detect, predict and monitor fraud; or
  • for the performance of a task in the public interest.
  • Right to Restriction of Processing: The right to require us to restrict processing of your personal data —in certain circumstances, e.g. if you contest the accuracy of the data, if your personal data was processed unlawfully and you request a limitation on processing, rather than the deletion of your personal data, we no longer need to process your personal data, but you require your personal data in connection with a legal claim, or you object to the processing pending verification as to whether an overriding legitimate ground for such processing exists. We may continue to store your personal data to the extent required to ensure that your request to limit the processing is respected in the future.
  • Right to Data Portability: The right to receive the personal data you provided to us, in a structured, commonly used and machine-readable format and/or transmit that data to a third party—in certain situations. At your request, we will provide you free of charge with your personal data in a structured, commonly used and machine readable format, if:
    • you provided us with personal data;
    • the processing of your personal data is based on your consent or required for the performance of a contract; or
    • the processing is carried out by automated means.
  • Right to Object: The right to object:
    • at any time to your personal data being processed for direct marketing (including profiling);
    • in certain other situations to our continued processing of your personal data, e.g. processing carried out for the purpose of our legitimate interests.
    • We will comply with your request unless we have compelling legitimate grounds for the processing which override your rights and freedoms, or where the processing is in connection with the establishment, exercise or defense of legal claims. Please note that even if we stop all marketing communications, you may still receive administrative communications from us.
  • Right Not to be Subject to Automated Individual Decision-Making: The right not to be subject to a decision based solely on automated processing (including profiling) that produces legal effects concerning you or similarly significantly affects you, unless you have given us your explicit consent or where they are necessary for a contract with us.
  • Right to withdraw consent: You have the right to withdraw any consent you may have previously given us at any time.

We hope that can resolve any query or concern you raise about our use of your personal data. However, the General Data Protection Regulation also gives you right to lodge a complaint with a supervisory authority, in the European Union (or European Economic Area) state where you work, normally live, or where any alleged infringement of data protection laws occurred.

How to Exercise Your Rights:

To exercise any of these rights regarding data for which we are the Data Controller, please contact us using the details provided in the "Contact Us" section below.

  • Description: We will need a description of what right you want to exercise and the information to which your request relates.
  • Verification: We will need to verify your identity before processing your request. We may require you to provide certain information to confirm your identity, such as your name, email address, or other details that help us match your request to the information we hold. We will only request information necessary for verification purposes.
  • Response Time: We will respond to your request within the timeframes required by applicable law (e.g., typically 30 or 45 days).
  • Authorized Agent: You may be able to use an authorized agent to submit a request on your behalf in accordance with applicable law. We will require the agent to provide proof of their authorization.

Please note that you may be restricted on the number of data access or data portability disclosures you may make within a 12-month period. We are not obligated to make a data access or data portability disclosure if we cannot verify that the person making the request is the person about whom we collected information, or is someone authorized to act on such person’s behalf.

California Specific Disclosures

Under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), certain disclosures of personal data, including making data available for cross-context behavioral advertising, may be considered a "sale" or "sharing." While we do not sell your personal data in the traditional sense (exchanging it for monetary value), our use of certain targeting cookies or similar technologies and service providers may be considered “selling” or "sharing" under these laws.

If our activities are considered a "sale" or "sharing" under applicable US state laws, you have the right to opt-out. Please see Section 13 ("Your Data Protection Rights").

In the preceding 12 months, we have sold to one or more third parties the following categories of personal data that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.
